Welcome to Pup & Feline Supply! The terms “we”, “us”, and “our” refer to Pup & Feline Supply. We operate this store and website, including all related information, content, features, tools, products, and services (the “Services”). Our storefront is hosted by Shopify.

These Terms of Service (the “Terms”), together with any policies referenced here (e.g., Privacy Policy and Refund Policy), describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, do not use the Services.

1. Access & Accounts

1.1 Eligibility. You represent that you are at least the age of majority in your province/state of residence and that you consent to any minor dependents using the Services on devices you own or manage.
1.2 Account Info. You may need to provide information (e.g., email, payment, shipping). You warrant it is accurate, current, and complete and that you have rights to provide it.
1.3 Security. You are responsible for safeguarding your credentials and all activity under your account. You may not sell, transfer, or license your account.

2. Our Products

2.1 Descriptions. We strive for accuracy but product colors/appearance can vary by device/settings.
2.2 No Warranties on Fit. We do not warrant that products or services will meet your expectations or match images.
2.3 Changes. Descriptions, availability, and pricing may change without notice. We may discontinue items or limit quantities to any person, region, or jurisdiction.

3. Orders

3.1 Offers. Your order is an offer to buy. We may accept or decline for any reason. Acceptance occurs when we confirm and process payment. Review orders carefully; cancellations after acceptance may not be possible. If we decline or cancel, we’ll attempt to notify you at the contacts you provided.
3.2 Returns. Purchases are subject to our Refund/Returns Policy [LINK].
3.3 Personal Use. You warrant purchases are for personal/household use—not for resale or export unless we expressly agree in writing.

4. Prices, Promotions & Billing

4.1 Prices. Prices may change without notice. The price at checkout/confirmation applies. Unless stated otherwise, prices exclude taxes, shipping, handling, duties, and import fees.
4.2 Promotions. Promotions/coupons have separate terms; if there’s a conflict, promo terms govern.
4.3 Billing. You agree to provide and maintain accurate payment/account details and authorize charges for your order (including taxes, shipping, and fees). You represent you’re authorized to use the payment method and that charges will be honored.

5. Shipping, Title & Risk of Loss

5.1 Timing. Delivery estimates are not guarantees. We are not liable for carrier delays, customs, or events beyond our control.
5.2 Risk Transfer. Title and risk of loss pass to you when we tender goods to the carrier.

6. Communications & SMS Program

6.1 Electronic Communications. By using the Services, you consent to receive service messages (e.g., order confirmations, shipping updates) electronically.
6.2 Marketing Emails/SMS. With your consent (as required by CASL in Canada and applicable U.S. laws such as TCPA for SMS), we may send promotional emails/SMS. You can opt out at any time via unsubscribe links or by contacting us. Message/data rates may apply; frequency varies. Consent is not a condition of purchase.

7. Intellectual Property

The Services and all content (trademarks, text, images, graphics, video, audio, layouts, and compilations) are owned by us or our licensors and protected by applicable IP laws. You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly stated. Our names, logos, and marks are our trademarks; Shopify’s marks are theirs. All other marks belong to their respective owners.

8. Optional Tools & Third-Party Links

8.1 Tools. Third-party tools or apps made available via the Services are provided “as is” and “as available” without warranties or endorsements. Your use is at your own risk and subject to the provider’s terms.
8.2 Links. Third-party sites and embedded features are governed by their policies. We are not responsible for their content, products, or practices.

9. Relationship with Shopify

Pup & Feline Supply is powered by Shopify. Sales on our store are between you and Pup & Feline Supply. Shopify is not responsible for your purchases from us. You expressly release Shopify and its affiliates from claims arising from your transactions with us.

10. Privacy

Personal information collected through the Services is subject to our Privacy Policy [LINK]. Because the Services are hosted by Shopify, Shopify also collects and processes certain information to operate and improve its platform. 11. Feedback & User Content

If you submit reviews, photos, ideas, or other content (“Feedback”), you grant us a worldwide, perpetual, irrevocable, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any lawful purpose. You represent you own or have rights to the Feedback, have disclosed any incentives, and that it complies with these Terms and applicable law. We may monitor, edit, or remove content in our discretion.

12. Errors & Availability

Information on the Services may contain typographical errors, inaccuracies, or omissions (including pricing, availability, and shipping details). We may correct, update, or cancel orders based on such information at any time without prior notice, including after an order is submitted.

13. Prohibited Uses

You may not use the Services to: (a) violate laws; (b) infringe IP rights; (c) harass or harm others; (d) transmit malware or spam; (e) collect others’ data without consent; (f) scrape or crawl; (g) interfere with security or normal operation; (h) misrepresent your identity; or (i) engage in conduct we deem harmful or abusive. We may suspend or terminate access for violations.

14. Export, Sanctions & Geographic Restrictions

You may not use the Services or purchase products in violation of export control, sanctions, or embargo laws of Canada, the U.S., or other applicable jurisdictions. We may restrict sales to specific regions.

15. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supply shortages, carrier issues, pandemics, government actions, or internet/service outages.

16. Termination

We may suspend or terminate your access at any time in our discretion. You remain responsible for amounts due up to termination. Sections that by their nature should survive (including IP, Feedback, Disclaimers, Liability Limits, Indemnity, Governing Law) will survive.

17. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY PUP & FELINE SUPPLY IN WRITING, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES/CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain disclaimers; in those places, only lawful limitations apply.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PUP & FELINE SUPPLY AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS (AND SHOPIFY AND ITS AFFILIATES) ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, OR GOODWILL; OR REPLACEMENT/ COVER COSTS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM OR CAD/USD $100, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limits; only lawful limits apply.

19. Indemnification

You agree to indemnify and hold harmless Pup & Feline Supply (and Shopify) and their respective officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your (a) breach of these Terms or incorporated policies, (b) violation of law or third-party rights, or (c) use of the Services. We may control the defense at your expense; you will cooperate fully.

20. Severability

If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remainder will remain in full force.

21. Waiver; Entire Agreement; Interpretation

Failure to enforce any provision is not a waiver. These Terms (plus policies referenced here) are the entire agreement between you and us and supersede prior understandings. Ambiguities are construed neutrally and not against the drafter.

22. Assignment

You may not assign or delegate your rights or obligations without our written consent. We may assign or delegate without notice.

23. Governing Law & Venue

These Terms and any non-contractual obligations are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Venue and jurisdiction lie exclusively in the courts located in British Columbia, Canada, and you consent to personal jurisdiction there.

24. Changes to Terms

You can review the current Terms on this page. We may update these Terms by posting a new version with a new “Last updated” date and, where required by law, additional notice. Your continued use of the Services after changes become effective constitutes acceptance.
